Real Estate Disputes

Real estate transactions often require buyers to rely on the representations and disclosures of sellers, the advice and representations of real estate agents and brokers, the findings and opinions of home inspectors, and the work of escrow professionals, contractors, and others involved in the transaction. When disputes arise, determining what was known, what was disclosed, what representations were made, and who bears responsibility can become complicated.

I represent homeowners, property owners, contractors, business owners, and real estate professionals in a wide variety of real estate disputes throughout California, including:

  • Residential purchase and sale transactions
  • Property disclosures and nondisclosures
  • Real estate agents and brokers
  • Escrow companies and escrow officers
  • Home inspectors
  • Construction and remodeling disputes
  • Contractors and subcontractors
  • Real estate co-owner disputes
  • Easement preparation and documentation
Real Estate Attorney

Real estate co-owner disputes often arise when people purchase or inherit property together without clearly defining their respective rights and responsibilities. Disputes involving ownership interests, management decisions, expenses, use of the property, and potential sale of the property can become difficult and costly if the parties do not share the same expectations.

Easement issues do not always arise in the context of litigation. I also assist property owners with the preparation and documentation of easements and related agreements designed to clarify property rights, establish access rights, and help avoid future disputes.

Every dispute is different. Some matters can be resolved through negotiation or mediation. Others require litigation. Determining the appropriate course of action depends on the facts of the case, the objectives of the parties involved, and the practical realities of the situation.

The goal is to identify the course of action that best serves the client’s interests while addressing both the legal and practical issues presented by the dispute.
